Paragraph 1. General Provisions

  1. These terms (Terms) define the rules of participation in the conference Medical Review Auschwitz: Medicine Behind the Barbed Wire (MRA), held on 23-25 September 2024. The official website of the conference is available at www.mp.pl/auschwitz/conference (MRA Website).
  2. The organizer of MRA is Fundacja Polski Instytut Evidence Based Medicine (Polish Institute for Evidence Based Medicine Foundation) (PIEBM), ul. Gazowa 14A, 31-060, Kraków, Poland, Court Register (KRS) number 0000154665, tax ID (NIP) 6762258220.
  3. The co-providers and program co-organizers of MRA are:
    1. Towarzystwo Lekarskie Krakowskie (Kraków Medical Society), ul. Radziwiłłowska 4, 31-026 Kraków, Poland;
    2. Instytut Pamięci Narodowej (Institute of National Remembrance), ul. Janusza Kurtyki 1, 02-676 Warsaw, Poland;
    3. Uniwersytet Jagielloński Collegium Medicum (Jagiellonian University Medical College), ul. Św. Anny 12, 31-008 Kraków, Poland;

  4. The scientific partners of MRA are:

  5. Participants (Participant(s)) are individuals who register and pay their registration fee through the MRA website.
  6. The Terms apply to all Participants of MRA and are available at the MRA website.
  7. MRA is conducted in English.
  8. MRA is an in-person event taking place in different venues:
    1. Day 1: private guided tour to the Auschwitz-Birkenau Memorial and Museum;
    2. Day 2: conference at the AST National Academy of Theatre Arts in Krakow (AST), ul. Straszewskiego 21-22, 31-109 Kraków, Poland;
    3. Day 3: workshops at the Jagiellonian University Medical College, ul. Św. Anny 12, 31-008 Kraków, Poland.

Paragraph 2. Participation and Cancellation Terms

  1. Participation in MRA is paid. The pricing is described on the MRA Website.
  2. Participation includes:
    1. Day 1: transport from Kraków to Auschwitz-Birkenau Memorial and Museum and back, refreshments, a guided tour in English with a special entry to Block 10 (up to 3 h);
    2. Day 2: course materials (PDF), refreshments and lunch, certificate of attendance with CME credits;
    3. Day 3: refreshments and lunch, certificate of attendance with CME credits.
  3. Participants can receive educational credits for participation in MRA under the rules established by the European Accreditation Council for Continuing Medical Education (UEMS/EACCME®). The condition for receiving the certificate and EACCME® credits is the purchase of and participation in MRA as well as submission of a filled-in evaluation questionnaire; the questionnaire shall be made available on the MRA website. The maximum number of credits that can be awarded for participation in MRA will be determined by a separate EACCME® resolution and will be announced on the MRA Website.
  4. Participants can withdraw their participation. Cancellations can be made prior to Day 1 of MRA and should be reported in writing to mra@piebm.org.
  5. The following shall apply to withdrawal of paid participation:
    1. if PIEBM receives a declaration of withdrawal from the Participant before August 31, the Participant shall receive a partial refund of 80% of the paid participation fee;
    2. from September 1, the participation fee is nonrefundable.
    3. PIEBM shall refund the payment within 30 days after the Participant has met all the requirements for submitting the withdrawal to the address mra@piebm.org; the refund will be made to the original payer using the same method of payment that was used for the purchase.
  6. The Participant must participate in MRA in a way that does not hinder or interfere with the conduct of MRA. The Participant must not undertake any actions that (a) are against the provisions of generally applicable law or good practice, (b) are in violation of other Participants’ rights of publicity, or (c) violate the legitimate interests of organizers or other Participants.
  7. To maintain safety, Participants are asked to comply with the health and safety rules and regulations.
  8. The organizers reserve the right to modify the MRA program at any time. Program changes are not acceptable grounds for requesting a refund.
  9. Participants agree to receive information about MRA via email.

Paragraph 3. Payment Terms

  1. Participation in MRA can be purchased through the official sales platform partner Ticket Generator. The Participants shall register and pay via the platform.
  2. PIEBM shall issue invoices for the payments made. The invoices shall be sent in PDF format to the email address provided at the time of purchase.
  3. The payer (invoice addressee) is the entity ordering individual services related to participation in MRA. Corrective invoices can only be issued in justified cases.
  4. If the Participant fails to pay the participation fee by the date specified on the MRA Website, PIEBM shall be entitled to cancel the Participant’s registration.

Paragraph 4. Complaints

  1. Complaints can be submitted in writing to mra@piebm.org.
  2. Participants can submit their complaints no later than 14 business days from the final day of MRA.
  3. Complaints submitted after the above-mentioned deadline will not be considered.

Paragraph 5. Personal Data

  1. The controller of Participants’ personal data is Fundacja Polski Instytut Evidence Based Medicine (Controller) with its registered seat at ul. Gazowa 14A, 31-060 Kraków, Poland. The Controller can be contacted in writing by post at the address above or by email sent to contact@piebm.org.
  2. The Controller has not appointed a data protection officer.
  3. Personal data are processed based on the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive?95/46/EC (General Data Protection Regulation; GDPR).
  4. The Controller processes Participants’ personal data in accordance with the following:
    1. Art. 6(1) of GDPR: for the purpose of recording and publishing the Participant’s image on the Controller’s websites and social media platforms such as, in particular, Facebook, Instagram, YouTube, Twitter, LinkedIn. The data will be processed until Participants withdraw their consent and will be handled thereafter as archived data;
    2. Art. 6 (1)(b) of GDPR: in order to enable participation in the event organized by the Controller. The data will be stored for 5 years following the event and will be handled as archived data;
    3. Art. 6(1)(c) of GDPR: for compliance with the Controller’s legal obligations, which include settlement of the participation fee for the event. The data will be stored for 5 years following the event and will be handled as archived data;
    4. Art. 6(1)(f) of GDPR: for the purpose of establishment, exercise, or defense of claims related to performance of the agreement. The data will be stored for 3 years of termination of the agreement.
  5. The Controller does not collect personal data from third parties.
  6. The Controller intends to transfer personal data to third countries or international organizations for the purpose of publishing the Participant’s image, among others, on Facebook or on internet platforms located outside of the European Economic Area, such as Vimeo, as well as to its partners co-organizing the event.
  7. The Controller will disclose Participants’ personal data to other entities exclusively under applicable laws as well as based on relevant entrustment agreements, for instance, with IT suppliers such as Ticket Generator, Microsoft Sp. z o.o., cyber_folks S.A., or Vimeo. The data can be disclosed to social media platforms, including Facebook, Instagram, YouTube, Twitter, or LinkedIn, which are separate data controllers.
  8. As data subjects, Participants have the right to:
    1. request access to their personal data, data rectification, erasure, or restriction of the processing of the data;
    2. object to the processing of their personal data;
    3. data portability;
    4. withdraw their consent at any time without impact on the lawfulness of processing based on their consent before its withdrawal;
    5. lodge a complaint in regard to processing of their data by the Controller with the President of the Data Protection Office.
  9. The provision of the Participant’s personal data is mandatory for participation in the event. The consent for the recording and publication of the Participant’s image and processing of the Participant’s personal data is voluntary.
  10. No automated decision making is to be carried out on the Participants’ personal data by the Controller.

Paragraph 6. Liability

PIEBM shall not be held responsible if:

  1. the Participant provides incorrect data;
  2. the Participant suffers losses and lost profits due to the following: providing incorrect data by the person who made the purchase; acts or omissions of third parties beyond the control of PIEBM; change of the MRA date or its cancellation due to force majeure such as natural disasters (fire, storms, floods), governmental or societal actions (war, invasion, civil unrest, labor strikes), and infrastructure failures (transportation, energy).

Paragraph 7. Intellectual Property

  1. The title and program of MRA, including the website, layout, logotypes, graphics, photographs, audio/video files, and presentations used in connection with MRA are the property of PIEBM and are legally protected.
  2. The above-specified brands and materials cannot be used without a written consent of the entity or person who is the owner. Reproducing training materials, recording of MRA lectures, and sharing such materials and recordings is illegal and is subject to protection under the Polish Act of 4 February 1994 on Copyright and Related Rights.

Paragraph 8. Miscellaneous

  1. If MRA has to be cancelled for reasons attributable solely to PIEBM, PIEBM shall immediately refund the fees paid by Participants to the Participants’ bank accounts using the data provided during registration.
  2. Any disputes arising in connection with the participation in MRA shall be resolved as follows:
    1. for Participants who are natural persons (consumers): by the competent court under the provisions of the Polish Act of 17 November 1964, Code of Civil Procedure (consolidated text: Journal of Laws of 2014, item 101, as amended);
    2. for Participants who are not consumers: by the court competent for the seat of PIEBM.
  3. In matters not covered by these Terms, appropriate provisions of law shall apply.
  4. These Terms become effective as of May 27, 2024.
